Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Hall A&M, doing business as Trufit Customs ("Trufit Customs", “we”, “us”, or “our”), concerning your access to and use of the trufitcustoms.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Site and you must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change.

It is your responsibility to periodically review these Terms of Use to stay informed of updates. Continued use of the Site after revised Terms are posted constitutes acceptance of the changes.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation.

The Site is not tailored to comply with industry-specific regulations (including HIPAA, FISMA, etc.). You may not use the Site in a way that would violate the Gramm-Leach-Bliley Act (GLBA).

All users who are minors (generally under 18) must have permission from, and be supervised by, a parent or guardian. Parents or guardians must read and agree to these Terms prior to a minor’s use of the Site.

Legal Disclaimer

Trufit Customs is not responsible for any dental complications, injuries, or damages that may result from the use of our products, including the impression process or the use of custom-fit mouthguards.

This includes, but is not limited to, loosening, displacement, or damage to crowns, bridges, fillings, veneers, orthodontic appliances, implants, or other existing dental work.

By using our products, customers acknowledge and accept all associated risks and assume full responsibility for any outcomes. Trufit Customs does not provide medical or dental advice, and our products are not intended to replace professional care.

Customers with existing dental restorations, orthodontic treatments, or oral health concerns are strongly advised to consult a licensed dental professional prior to use. Use of Trufit Customs products constitutes acceptance of these terms.

Intellectual Property Rights

Unless otherwise indicated, the Site and all content—including source code, databases, functionality, software, designs, text, images, audio, video, and graphics (“Content”)—and trademarks, service marks, and logos (“Marks”) are owned or licensed by us and protected by intellectual property laws.

The Content and Marks are provided “AS IS” for personal, non-commercial use only. Except as expressly permitted, no part of the Site or Content may be copied, reproduced, distributed, sold, or exploited without prior written permission.

You are granted a limited, non-transferable license to access and use the Site for personal, non-commercial purposes only. All rights not expressly granted are reserved.

User Representations

By using the Site, you represent and warrant that:

1. All information you submit is accurate and complete
2. You will maintain and update your information
3. You have legal capacity and agree to comply with these Terms
4. You are not a minor or have parental consent
5. You will not use automated access methods
6. You will not use the Site for unlawful purposes
7. Your use will comply with all applicable laws

Providing false or incomplete information may result in suspension or termination of access.

User Registration

You may be required to register an account. You are responsible for maintaining password confidentiality and all activity under your account.

We reserve the right to remove or change usernames deemed inappropriate or objectionable.

Products

We strive to accurately display product details but do not guarantee accuracy, completeness, or availability. Products and pricing are subject to change without notice.

Customization Policy

• Once impressions are verified and scanned, customization for that order is no longer available.
• If impressions are received before customization is completed, a standard white and black guard will be produced.

Refund Policy

• Only products are refundable
• Impression kits are non-refundable
  • Insole kits: $45
  • Impression kits: $30

Purchases and Payment

You agree to provide accurate billing information and authorize charges for purchases, shipping, taxes, and any recurring payments.

Prohibited Activities

You may not use the Site for unauthorized or unlawful purposes.

Prohibited Actions Include (but are not limited to):

1. Data scraping or database compilation
2. Unauthorized account creation
3. Advertising or resale activities
4. Security circumvention
5. Automated system use
6. Harassment or impersonation
7. Reverse engineering
8. Malware transmission
9. Violation of applicable laws

Violation may result in termination of access.

User Generated Contributions

The Site does not generally allow content submissions, but where permitted, users represent and warrant that contributions:

• Do not infringe third-party rights
• Are lawful, accurate, and non-misleading
• Are not abusive, obscene, or discriminatory
• Do not violate these Terms or applicable law

Violation may result in suspension or termination.

Contribution License

You retain ownership of your Contributions. By submitting them, you grant us the right to use, store, and process them per our Privacy Policy.

We are not responsible for statements made in user Contributions.

Guidelines for Reviews

Reviews must be honest, respectful, lawful, and based on firsthand experience. We reserve the right to remove reviews at our discretion.

By posting a review, you grant us a perpetual, royalty-free license to use it.

Submissions

All feedback and submissions become our property and may be used without compensation. You waive all moral rights to submitted materials.

Site Management

We reserve the right to monitor, restrict, remove, or disable content or accounts to protect the Site and enforce these Terms.

Privacy Policy

By using the Site, you agree to our Privacy Policy. Data may be processed and stored in the United States regardless of your location.

Copyright Infringements

If you believe your copyright is infringed, submit a formal notification using the contact information below. False claims may result in liability.

Term and Termination

These Terms remain in effect while you use the Site. We may suspend or terminate access at any time without notice.

Modifications and Interruptions

We may modify or discontinue the Site or Marketplace Offerings at any time without liability. Availability is not guaranteed.

Dispute Resolution

Informal Negotiations

Parties agree to attempt informal resolution for 30 days before arbitration.

Binding Arbitration

Disputes will be resolved by binding arbitration under AAA rules unless legally exempt.

Restrictions

• No class actions
• No representative claims

Certain disputes (IP, theft, injunctive relief) are excluded.

Corrections

We may correct errors or omissions on the Site at any time without notice.

Disclaimer

The Site is provided “AS IS” and “AS AVAILABLE.” Use is at your sole risk. We disclaim all warranties to the fullest extent permitted by law.

Limitations of Liability

Our liability is limited to the amount paid by you in the six (6) months preceding the claim. Some jurisdictions may not allow certain limitations.

Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Site or violation of these Terms.

User Data

We are not responsible for data loss or corruption. You waive claims related to such loss.

Electronic Communications, Transactions, and Signatures

You consent to electronic communications and signatures and waive requirements for non-electronic records.

California Users and Residents

Unresolved complaints may be directed to the California Department of Consumer Affairs.

Miscellaneous

These Terms constitute the entire agreement. If any provision is unenforceable, the remainder remains valid.
